RECITALS:
America's Best Agents, Inc. warrants
that it is the owner of the proprietary rights associated
with the combination of the domain name “America's
Best Agents” together with the internet services, access
rights, and site maintenance services offered by America's Best Agents, Inc.
to populate the America's Best Agents, Inc. web site (the “Web site”), and;
America's Best Agents, Inc. has the
right and authority to enter into and sell advertising and
membership rights as set forth in this Agreement, and;
Purchaser is in the business of promoting
and selling real estate or real estate services, and has
agreed to purchase advertising on America's Best Agents, Inc. Internet Web site link to be created for the Purchasers'
use, now
IN CONSIDERATION of the mutual benefits
to be derived hereunder, parties agree as follows:
1. America’s Best Agents, Inc.
Business Operation. America's Best Agents, Inc. operates the America's Best Agents, Inc. Internet Web
site. The Web site showcases and markets quality residential
homes,estates and services on behalf of its subscribing
customers. Each Membership Agreement Web site participant
receives the following services: (1)A directory listing designed
(for America's Best Memberships Only) to display and promote
the participant and his (her) real estate listings on the
America's Best Agents, Inc.' Web site. America's Best Agents
when combined with other America's Best Agents creates a
global network of showcased residential homes,estates and
real estate agents. A virtual office of Marketing Tools Open
24 hours a day, 7days a week and 365 days a year unless
there are Internet Problems out of the control of Agents, Inc.
2. America’s Best Agents, Inc.
has entered into joint ventures and partnerships
with other companies to provide tools and services to the
Purchaser and has no control over the other companies performances,
procedures, policies and practices. Several of these services
and tools have separate agreements and fee arrangements and
the purchaser has the option to join and pay these companies
according to that particular companies rules and regulations.
3. America's Best Agents, Inc. & America's Best Agents agrees to provide you the following:
- A Press release to give to their paper announcing they are America's Best.
- A Free Website and membership in Point 2 Agent that has over 80,000 members to network with.
- A Free Listing on
- Free featured home listings on
- Networing with other top Realtors they can send referrals to and get referral fees.
- Exclusivity there will be only one America's Best Agent per neighborhood.
- for your buyers and sellers to sell anything of value
(Every America's Best Agent will have this great advertising tool that will help bring buyers and sellers back to their website)
Purchaser Agrees to Provide all necessary
photo's and logo's required for the set-up, of any web sites
or directory listings. Purchaser agree's to keep all their
information current and correct.
All Purchaser must keep their
membership current and payments up to date. If
any Purchaser is not current on their payments they will
be automatically deleted from America's Best Real Estate
Center after being late more than 30 days on any payment.
They will not be allowed to use any logo's or America' Best
in any of their advertising nor promote themselves as America's
Best Agent.
All Real Estate Agents Must Have A Valid
Real Estate License and must provide the best marketing tools
and highest integrity in his or her business when representing
all clients and customers. All agents must abide by the Equal
Housing Opportunity Laws. All service providers must have
a satisfaction guaranteed program.
